The terms and conditions (Terms) set out below constitute a binding agreement between Otago Event Planning Limited (Promoter) and the person (you) holding or using a ticket (Ticket) to the event (Event) irrespective of whether the Ticket was purchased by the person holding or using the Ticket. The Terms must be read in conjunction with all statements and directives shown or displayed on your Ticket, on-site at the Event, on the Promoter’s website and social media pages, or otherwise communicated by the Promoter from time to time, as these are deemed to be included in the Terms.
The Promoter reserves the right to vary these Terms at any time. Any variation will be effective immediately upon posting of the amended Terms on the Promoter’s website.
Your Ticket
When purchasing Tickets for the Event, you may be limited to a specified number of Tickets. If you exceed the stated limit you may have any or all of your orders and Tickets cancelled without notice by the Promoter. This includes orders associated with the same name, email address, billing address, credit card information or other information. Ticket limits apply to ensure fair access to Tickets and to reduce scalping.
Your Ticket, in electronic or paper form must be presented in order to gain admittance to the Event. The code on the Ticket uniquely identifies your Ticket and can be redeemed only once. If you are over the age of 18, you may be required to provide photo identification, which must match the name on the Ticket. If identification is not provided or does not match the name on the Ticket, the Promoter may deny you entry to the Event. The following identification will be accepted; a New Zealand Driver’s License, a New Zealand or Foreign Passport, Kiwi Access card or a HANZ 18+ card.
Tickets purchased online will be available to be printed by accessing the link contained in the confirmation email. You are responsible for printing your Ticket or providing the electronic version of the Ticket to gain entry to the Event.
While the Promoter takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. The Promoter may cancel an order made as a result of such error, although in the case of a pricing error, the Promoter will endeavour to contact you to give you the option of purchasing the Ticket at the correct price.
Pricing and fees
All Ticket prices are in New Zealand Dollars (NZD$) unless otherwise stated. All prices include GST unless otherwise stated.
All Tickets purchased through the Promoter are subject to a per Ticket service fee.
All transactions made by credit card are subject to a card processing fee.
Transfer of Tickets
Where you wish to transfer or on-sell your ticket, you must contact the Promoter, at least one week before the Event, with the details of the Tickets being transferred and the name(s) of the transferee(s). The Promoter may then, in its sole discretion, approve the transfer of the Ticket(s) and update the name on the Ticket(s).
If you have purchased a Ticket, from someone other than the Promoter, and that Ticket is fraudulent or the name on the Ticket does not match the identification of the person seeking admittance to the Event, the Promoter may deny you entry to the Event.
No Ticket may be resold at a premium, used for advertising, promotion or other commercial purposes without prior written approval from the Promoter.
Any complimentary Tickets provided by the Promoter may not, without the prior written consent of the Promoter in each instance, be sold, transferred or used by anyone other than the person whose name is on the Ticket or to which the Ticket is registered. Where there is a breach of this clause the Promoter may deny any entry to the Event using the relevant Tickets involved in the breach.
WARNING: The resale of Tickets in certain circumstances is governed by sales legislation and may attract criminal penalties.
Cancellations
If the Event cannot take place (in whole or in part) due to an event, circumstance, or situation outside of the Promoter’s reasonable control (including but not limited to any act of God, natural disaster, fire, flood, weather event, council or government sanction or order, actions or decisions of police or other authorities, act of terrorism, war or industrial action, or cancellation by the Venue owner (Specified Event) then the Promoter may, at their sole discretion, cancel or postpone the Event.
Where, due to the COVID government alert level (or any replacement system for COVID, or other pandemic or epidemic) (Covid Event) in Wānaka, or any other location, the Event is not feasible (as determined by the Promoter, at its sole discretion), the Promoter may at their sole discretion, cancel or postpone the Event.
Where the Event is postponed or cancelled due to a Covid Event or a Specified Event, you will not be entitled to a refund.
Where the Event is postponed due to a Covid Event or Specified Event and the postponed Event is cancelled, you will have the right to transfer your Ticket to the next Event (provided the Promoter confirms this will proceed). If you wish to transfer your Ticket, you must give the Promoter notice in writing within 2 weeks of event cancellation notice.
Where the Event is cancelled for a reason other than a Specified Event or a Covid Event, your Ticket price will be 100% refundable (excluding any booking or service fees paid to the Promoter). If the Event is cancelled in accordance with this clause 5, you may elect to have your Ticket transferred to the next Event (provided the Promoter confirms this will proceed).
Where the Event is postponed due to a reason other than a Specified Event or a Covid Event, and the postponed Event is cancelled, you will have the same rights to a refund/transfer as set out in clause 5.
Other than as provided in this clause 6, Tickets are non-refundable.
Proof of purchase may be required for any refund.
The Promoter makes no guarantee that the Event will operate and takes no responsibility for any loss incurred by you caused by cancellation or postponement of the Event.
General Terms
Once you leave the Event you cannot re-enter.
Admission is at your own risk. The Promoter will not be liable for any loss or damage or liability of any kind whatsoever (including consequential loss) whether suffered or incurred by you or another person and whether in contract, or tort (including in negligence), or otherwise and whether such loss or damage arises directly or indirectly from your use or the inability to use the Ticket(s) or from the Event.
By purchasing Tickets on behalf of others, you acknowledge that those parties are aware of all terms and conditions relating to their Tickets and their entry and attendance at the Event.
The Promoter will use reasonable endeavours to make the Venue accessible for those using wheelchairs, mobility scooters or with a disability. However, you acknowledge that the Venue has pre-existing natural terrain and it may be not be practicable to make all areas of the Venue accessible for all patrons.
Smoking and vaping are only permitted in the dedicated smoking areas at the Event.
There will be no cash used on site, you will need a debit/credit card to make all purchases.
You are not permitted to display any trading signs at the Event without prior written consent of Promoter.
Safety
The Promoter and its authorised employees reserve the right to prohibit entry to, and remove all, persons under the influence of drugs, or engaging in disruptive or dangerous behaviour including, without limitation; throwing, casting, thrusting or firing any objects; instigating violence, racism or xenophobia; behaving in a way that others may interpret as provocative, threatening, discriminatory, or offensive; creating any threat to the life or safety of themselves or others, or harming another person in any way whatsoever.
All bags are subject to inspection at any point during the Event. Bottles, cans, glass, food, drink, alcohol, illicit drugs, illegal substances, fireworks, explosives, or any other items that may interfere with the enjoyment, comfort or safety of other persons or security at the Event cannot be brought into the Event.
Animals (except for certified guide dogs) and furniture are not permitted at the Event.
Licensed Event
For the purchase and consumption of alcohol, you must provide photo identification to the satisfaction of the Promoter and/or its employees and vendors. The following identification will be accepted; a New Zealand Driver’s License, a New Zealand or Foreign Passport, Kiwi Access card or a HANZ 18+ card.
Alcohol cannot be taken outside the Event.
Alcohol will not be served to anyone who is intoxicated. Anyone deemed intoxicated will be denied entry to the Event and/or asked to leave the Event at any time during the Event and will not be permitted re-entry into the Event.
Privacy
You authorise the Promoter to collect, retain and use information about you for the purpose of organising and operating the Event, and any future events operated by the Promoter, and to disclose information about you, as is reasonably required for these purposes.
Promotional photos and videos will be taken at the Event and by purchasing a Ticket and entering the Event you give permission for your likeness to be used by the Promoter. If you do not want your image used by the Promoter in any future promotional activity please contact the Promoter.
